A BILL TO BE ENTITLED
 
AN ACT
  relating to the operation of a quick draw lottery game; requiring an
  occupational license.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 466.002, Government Code, is amended by
  adding Subdivision (8-a) to read as follows:
               (8-a)  "Quick draw lottery game" means a lottery game
  in which a drawing to select the winning ticket occurs 12 to 15
  times per hour between the hours of 7 a.m. and 2 a.m. of the
  following day.
         SECTION 2.  Subchapter B, Chapter 466, Government Code, is
  amended by adding Section 466.0275 to read as follows:
         Sec. 466.0275.  QUICK DRAW LOTTERY GAME; SALES AGENT LICENSE
  FOR QUICK DRAW LOTTERY GAME. (a)  The commission shall operate a
  quick draw lottery game. The commission shall:
               (1)  determine the ticket price, payout amounts, and
  manner in which the game is conducted;
               (2)  restrict the locations authorized to sell the
  quick draw lottery game tickets to only locations licensed as sales
  agents in accordance with Subsection (b); and
               (3)  ensure the game remains competitive with other
  lottery games the commission offers.
         (b)  The commission may license as sales agents to sell quick
  draw lottery game tickets only holders of one of the following
  permits or licenses issued by the Texas Alcoholic Beverage
  Commission for locations that provide on-premises consumption of
  alcohol:
               (1)  a winery permit;
               (2)  a wine and malt beverage retailer's permit;
               (3)  a mixed beverage permit;
               (4)  a private club registration permit;
               (5)  a retail dealer's on-premise license;
               (6)  a brewpub license;
               (7)  a brewer's license; or
               (8)  a distiller's and rectifier's permit.
         (c)  Section 466.155(a)(4)(C) does not apply to a sales agent
  who is licensed to sell quick draw lottery game tickets.
         (d)  The commission shall market and advertise the lottery
  game operated under this section in a manner intended to inform the
  public that the game tickets are available for purchase from
  licensed sales agents described by Subsection (b).
         (e)  The commission shall adopt the rules necessary to
  operate a quick draw lottery game.
         SECTION 3.  As soon as practicable after the effective date
  of this Act but not later than January 1, 2024, the Texas Lottery
  Commission shall implement Section 466.0275, Government Code, as
  added by this Act, by adopting all necessary rules and procedures,
  issuing sales agent licenses, and establishing the quick draw
  lottery game.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
