| relating to the preference given by state agencies for certain | ||
| goods and services produced or offered by small businesses. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter H, Chapter 2155, Government Code, is | ||
| amended by adding Section 2155.454 to read as follows: | ||
| Sec. 2155.454. PREFERENCE FOR SMALL BUSINESS. (a) In this | ||
| section, "small business" has the meaning assigned by Section | ||
| 2155.505. | ||
| (b) Except as provided by Subsection (c), the comptroller | ||
| and each state agency that enters into a contract for the purchase | ||
| of goods or services with a value of less than $500,000 shall give | ||
| preference to goods or services produced or offered by a small | ||
| business. | ||
| (c) This section does not apply to the purchase of | ||
| telecommunications equipment, telecommunications service, | ||
| advanced communications services, or information service, as those | ||
| terms are defined by 47 U.S.C. Section 153. | ||
| (d) The comptroller may adopt rules to implement this | ||
| section. | ||
| SECTION 2. The change in law made by this Act applies only | ||
| to a contract for the purchase of goods or services that is entered | ||
| into on or after the effective date of this Act. A contract entered | ||
| into before the effective date of this Act is governed by the law in | ||
| effect on the date the contract was entered into, and the former law | ||
| is continued in effect for that purpose. | ||
| SECTION 3. This Act takes effect September 1, 2021. | ||
