A BILL TO BE ENTITLED
 
AN ACT
  relating to the employment of certain executive heads of state
  agencies and employees reporting to those executive heads.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  The heading to Chapter 669, Government Code, is
  amended to read as follows:
  CHAPTER 669.  RESTRICTIONS [ON CERTAIN ACTIONS] INVOLVING CERTAIN
  STATE EMPLOYEES [EXECUTIVE HEAD OF STATE AGENCY]
         SECTION 2.  Chapter 669, Government Code, is amended by
  adding Section 669.005 to read as follows:
         Sec. 669.005.  LIMITATION ON EMPLOYMENT DURATION FOR CERTAIN
  POSITIONS; DUTY TO REVIEW.  (a)  This section applies only to:
               (1)  the executive head of a state agency that is
  governed by a governing body; and
               (2)  an employee in a position that reports directly to
  the executive head described by Subdivision (1).
         (b)  An individual may not serve as the executive head of a
  state agency, or in a position that reports directly to the
  executive head of the state agency, for a period that exceeds 10
  years.
         (c)  Not later than the fifth anniversary of the date an
  individual is employed:
               (1)  as the executive head of a state agency, the
  governing body of the state agency shall review the individual's
  performance and determine whether to terminate the individual's
  employment; or
               (2)  in a position that reports directly to the
  executive head of the state agency, the executive head shall review
  the individual's performance and determine whether to terminate the
  individual's employment.
         SECTION 3.  The change in law made by this Act applies only
  to a contract entered into on or after the effective date of this
  Act.  A contract entered into before the effective date of this Act
  is governed by the law in effect on the date the contract was
  entered into, and the former law is continued in effect for that
  purpose.
         SECTION 4.  This Act takes effect September 1, 2025.
