Protection and Affordable Care Act. | ||
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 51-a, Article III, Texas Constitution, | ||
is amended by adding Subsection (b-1) to read as follows: | ||
(b-1) Notwithstanding Subsection (b) of this section, the | ||
state may not provide medical assistance to any person who became | ||
newly eligible for that assistance under the Patient Protection and | ||
Affordable Care Act (Pub. L. No. 111-148), as amended by the Health | ||
Care and Education Reconciliation Act of 2010 (Pub. L. | ||
No. 111-152), but would not be eligible for that assistance under | ||
the eligibility criteria in effect in this state on January 1, 2021. | ||
SECTION 2. This proposed constitutional amendment shall be | ||
submitted to the voters at an election to be held November 2, 2021. | ||
The ballot shall be printed to provide for voting for or against the | ||
proposition: "The constitutional amendment prohibiting the state | ||
from expanding eligibility for Medicaid under the federal Patient | ||
Protection and Affordable Care Act." |
