| proposing a constitutional amendment authorizing the legislature | ||
| to legalize wagering in this state on certain sporting events. | ||
| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 47, Article III, Texas Constitution, is | ||
| amended by amending Subsection (a) and adding Subsection (f) to | ||
| read as follows: | ||
| (a) The Legislature shall pass laws prohibiting lotteries | ||
| and gift enterprises in this State other than those authorized by | ||
| Subsections (b), (d), (d-1), [ |
||
| (f) The legislature by law may authorize and regulate the | ||
| placing of wagers on sporting events. A law enacted under this | ||
| subsection may authorize the conduct of sports wagering only by: | ||
| (1) a sports team, as defined by general law, in | ||
| existence on January 1, 2025; | ||
| (2) a sports organization that held in this state | ||
| before January 1, 2025, sanctioned annual professional golf | ||
| tournaments as part of a national tour of professional golfers; | ||
| (3) a class 1 racetrack in operation on January 1, | ||
| 2025; or | ||
| (4) a designee of an entity described by Subdivisions | ||
| (1)-(3) of this subsection. | ||
| SECTION 2. This proposed constitutional amendment shall be | ||
| submitted to the voters at an election to be held November 4, 2025. | ||
| The ballot shall be printed to permit voting for or against the | ||
| proposition: "The constitutional amendment authorizing the | ||
| legislature to legalize wagering in this state on certain sporting | ||
| events." | ||
