proposing a constitutional amendment regarding the dedication by | ||
general law of revenue of or money received by this state and money | ||
held in or deposited to an account or fund inside or outside the | ||
state treasury and the authorized expenditure or appropriation of | ||
revenue or money dedicated by general law. | ||
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article VIII, Texas Constitution, is amended by | ||
adding Section 25 to read as follows: | ||
Sec. 25. (a) The legislature by general law may dedicate | ||
to one or more particular purposes the appropriation or expenditure | ||
of: | ||
(1) revenue of, or money received by, this state from | ||
one or more particular sources; or | ||
(2) money held in or deposited to an identified | ||
account or fund inside of or outside of the state treasury. | ||
(b) Subsection (a) of this section does not authorize a | ||
dedication by general law of revenue or money otherwise dedicated | ||
by this constitution in a manner that is inconsistent with that | ||
constitutional dedication. | ||
(c) Revenue or money the appropriation or expenditure of | ||
which is dedicated by general law to a purpose or purposes as | ||
described by Subsection (a) or (b) of this section may not be | ||
expended or appropriated for any purpose other than the dedicated | ||
purpose or purposes, except as authorized by a subsequently adopted | ||
general law that: | ||
(1) expressly amends or repeals the general law under | ||
which the revenue or money was dedicated; and | ||
(2) is adopted by a record vote of two-thirds of the | ||
membership of both houses of the legislature. | ||
SECTION 2. The following temporary provision is added to | ||
the Texas Constitution: | ||
TEMPORARY PROVISION. (a) This temporary provision applies | ||
to the constitutional amendment proposed by the 82nd Legislature, | ||
Regular Session, 2011, regarding the dedication by general law of | ||
revenue of or money received by this state and money held in or | ||
deposited to an account or fund inside or outside the state treasury | ||
and the authorized expenditure or appropriation of revenue or money | ||
dedicated by general law. | ||
(b) Section 25, Article VIII, of this constitution takes | ||
effect September 1, 2013, and applies only to appropriations | ||
authorized for or expenditures during a state fiscal year beginning | ||
on or after that date. | ||
(c) This temporary provision expires January 1, 2014. | ||
SECTION 3. This proposed constitutional amendment shall be | ||
submitted to the voters at an election to be held November 8, 2011. | ||
The ballot shall be printed to provide for voting for or against the | ||
proposition: "The constitutional amendment regarding the | ||
dedication by general law of revenue of or money received by this | ||
state and money held in or deposited to an account or fund inside or | ||
outside the state treasury and the authorized expenditure or | ||
appropriation of revenue or money dedicated by general law." |
