safety of public school students and staff. | ||
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article VII, Texas Constitution, is amended by | ||
adding Section 7 to read as follows: | ||
Sec. 7. (a) The board of trustees of an independent school | ||
district or the governing body of a charter school is responsible | ||
for decisions regarding the health and safety of the district's or | ||
school's students and staff. | ||
(b) The legislature or a state agency may not withhold | ||
funding from an independent school district or charter school | ||
because of a decision made by the board of trustees or governing | ||
body of the district or school to halt in-person learning due to | ||
concerns for the health and safety of students or staff. | ||
(c) The legislature may not pass a law that arbitrarily | ||
disregards the health and safety of public school students or | ||
staff. | ||
SECTION 2. This proposed constitutional amendment shall be | ||
submitted to the voters at an election to be held November 2, 2021. | ||
The ballot shall be printed to permit voting for or against the | ||
proposition: "The constitutional amendment protecting the health | ||
and safety of public school students and staff." |
