proposing a constitutional amendment eliminating the statute of | ||
limitations for suits for personal injury arising from certain | ||
sexual offenses against a child. | ||
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article I, Texas Constitution, is amended by | ||
adding Section 37 to read as follows: | ||
Sec. 37. (a) Regardless of any statute of limitation, a | ||
person may bring a suit for personal injury at any time if the | ||
injury arose as a result of conduct that violates a penal law | ||
involving a sexual offense against a child. | ||
(b) In this section, "sexual offense" means: | ||
(1) sexual assault of a child; | ||
(2) aggravated sexual assault of a child; | ||
(3) continuous sexual abuse of a young child; | ||
(4) trafficking of a child and causing the child to | ||
engage in or become the victim of conduct that violates a penal law | ||
involving: | ||
(A) continuous sexual abuse of a young child; | ||
(B) indecency with a child; | ||
(C) sexual assault; | ||
(D) aggravated sexual assault; or | ||
(E) compelling prostitution; | ||
(5) sexual conduct with a trafficked child; | ||
(6) compelling prostitution by a child; or | ||
(7) indecency with a child. | ||
SECTION 2. This proposed constitutional amendment shall be | ||
submitted to the voters at an election to be held November 4, 2025. | ||
The ballot shall be printed to permit voting for or against the | ||
proposition: "The constitutional amendment eliminating the | ||
statute of limitations for suits for personal injury arising from | ||
certain sexual offenses against a child." |
