BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article XVI, Texas Constitution, is amended by | ||
adding Section 74 to read as follows: | ||
Sec. 74. The state shall provide medical assistance to all | ||
persons who apply for that assistance and for whom federal matching | ||
funds are available under the Patient Protection and Affordable | ||
Care Act (Pub. L. No. 111-148), as amended by the Health Care and | ||
Education Reconciliation Act of 2010 (Pub. L. No. 111-152), to the | ||
state to provide that assistance. | ||
SECTION 2. The following temporary provision is added to | ||
the Texas Constitution: | ||
TEMPORARY PROVISION. (a) This temporary provision applies | ||
to the constitutional amendment proposed by the 88th Legislature, | ||
1st Called Session, 2023, requiring the state to expand eligibility | ||
for Medicaid to all persons for whom federal matching funds are | ||
available under the federal Patient Protection and Affordable Care | ||
Act. | ||
(b) Section 74, Article XVI, of this constitution takes | ||
effect January 1, 2024. | ||
(c) This temporary provision expires January 1, 2025. | ||
SECTION 3. This proposed constitutional amendment shall be | ||
submitted to the voters at an election to be held November 7, 2023. | ||
The ballot shall be printed to provide for voting for or against the | ||
proposition: "The constitutional amendment requiring the state to | ||
expand eligibility for Medicaid to all persons for whom federal | ||
matching funds are available under the federal Patient Protection | ||
and Affordable Care Act. |
