proposing a constitutional amendment requiring the state to expand | ||

Patient Protection and Affordable Care Act. | ||
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article XVI, Texas Constitution, is amended by | ||
adding Section 74 to read as follows: | ||
Sec. 74. The state shall provide medical assistance to all | ||
individuals who apply for that assistance and for whom federal | ||
matching funds are available under the Patient Protection and | ||
Affordable Care Act (Pub. L. No. 111-148), as amended by the Health | ||
Care and Education Reconciliation Act of 2010 (Pub. L. No. | ||
111-152), to the state to provide that assistance. | ||
SECTION 2. The following temporary provision is added to | ||
the Texas Constitution: | ||
TEMPORARY PROVISION. (a) This temporary provision applies | ||
to the constitutional amendment proposed by the 89th Legislature, | ||
Regular Session, 2025, requiring the state to expand eligibility | ||
for Medicaid to all individuals for whom federal matching funds are | ||
available under the federal Patient Protection and Affordable Care | ||
Act. | ||
(b) Section 74, Article XVI, of this constitution takes | ||
effect January 1, 2026. | ||
(c) This temporary provision expires January 1, 2027. | ||
SECTION 3. This proposed constitutional amendment shall be | ||
submitted to the voters at an election to be held November 4, 2025. | ||
The ballot shall be printed to provide for voting for or against the | ||
proposition: "The constitutional amendment requiring the state to | ||
expand eligibility for Medicaid to all individuals for whom federal | ||
matching funds are available under the federal Patient Protection | ||
and Affordable Care Act." |
