proposing a constitutional amendment providing for the creation of | ||
the Texas resilience infrastructure fund to assist in the financing | ||
of resilience projects. | ||
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article III, Texas Constitution, is amended by | ||
adding Section 49-d-14 to read as follows: | ||
Sec. 49-d-14. (a) The Texas resilience infrastructure | ||
fund is created as a special fund in the state treasury outside the | ||
general revenue fund. | ||
(b) As provided by general law, money in the Texas | ||
resilience infrastructure fund may be administered and used, | ||
without further appropriation, by the Texas Water Development Board | ||
or that board's successor in function to provide financing for | ||
projects to prevent flooding or mitigate damage from flooding | ||
related to a rainstorm, tropical storm or depression, hurricane, or | ||
storm surge affecting in this state or coastal public land: | ||
(1) public health or welfare; | ||
(2) public or private property; or | ||
(3) habitat for fish or wildlife. | ||
(c) Separate accounts may be established in the Texas | ||
resilience infrastructure fund as necessary to administer the fund | ||
or authorized projects. | ||
SECTION 2. This proposed constitutional amendment shall be | ||
submitted to the voters at an election to be held November 5, 2019. | ||
The ballot shall be printed to permit voting for or against the | ||
proposition: "The constitutional amendment providing for the | ||
creation of the Texas resilience infrastructure fund to assist in | ||
the financing of resilience projects." |
