persons who are unlawfully present in the United States and are | ||
taken into custody for committing a felony. | ||
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article I, Texas Constitution, is amended by | ||
adding Section 11d to read as follows: | ||
Sec. 11d. A person taken into custody for committing a | ||
felony shall be denied release on bail pending trial if a judge or | ||
magistrate, following a hearing, determines that the person is not | ||
a citizen or national of the United States and is not lawfully | ||
present in the United States. | ||
SECTION 2. This proposed constitutional amendment shall be | ||
submitted to the voters at an election to be held November 8, 2011. | ||
The ballot shall be printed to provide for voting for or against the | ||
proposition: "The constitutional amendment denying bail to certain | ||
persons who are unlawfully present in the United States and are | ||
taken into custody for committing a felony." |
