A BILL TO BE ENTITLED
 
AN ACT
  relating to requiring payment and performance bonds for certain
  public work contracts.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 11.0171, Parks and Wildlife Code, is
  amended by adding Subsection (a-1) to read as follows:
         (a-1)  For a contract described by Subsection (a)(2) that is
  also a public work contract, as that term is defined by Section
  2253.001, Government Code, the director shall require the
  contractor, before beginning work on the contract, to execute with
  the department:
               (1)  a performance bond if the contract is greater than
  $150,000; and
               (2)  a payment bond if the contract is greater than
  $150,000.
         SECTION 2.  (a) Section 11.0171, Parks and Wildlife Code, as
  amended by this Act, applies only to a public work contract for
  which the Parks and Wildlife Department first advertises or
  otherwise requests bids, proposals, or qualifications, or makes a
  similar solicitation, on or after the effective date of this Act.
         (b)  A public work contract for which the Parks and Wildlife
  Department first advertises or otherwise requests bids, proposals,
  or qualifications, or makes a similar solicitation, before the
  effective date of this Act is governed by the law as it existed
  immediately before that date, and that law is continued in effect
  for that purpose.
         SECTION 3.  This Act takes effect September 1, 2025.
