relating to the composition of the permanent advisory committee to | ||
advise the Texas Commission on Environmental Quality regarding the | ||
implementation of the ad valorem tax exemption for pollution | ||
control property. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subsection (n), Section 11.31, Tax Code, is | ||
amended to read as follows: | ||
(n) The Texas Commission on Environmental Quality shall | ||
establish a permanent advisory committee consisting of | ||
representatives of industry, appraisal districts, taxing units, | ||
and environmental groups, as well as members who are not | ||
representatives of any of those entities but have substantial | ||
technical expertise in pollution control technology and | ||
environmental engineering, to advise the commission regarding the | ||
implementation of this section. At least one member of the advisory | ||
committee must be a representative of a school district or junior | ||
college district in which property is located that is or previously | ||
was subject to an exemption under this section. Chapter 2110, | ||
Government Code, does not apply to the size, composition, or | ||
duration of the advisory committee. | ||
SECTION 2. As soon as practicable after the effective date | ||
of this Act, the Texas Commission on Environmental Quality shall | ||
appoint one or more representatives of school districts or junior | ||
college districts in which property is located that is or | ||
previously was subject to an exemption under Section 11.31, Tax | ||
Code, to the permanent advisory committee established under | ||
Subsection (n) of that section, as amended by this Act. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2011. |
