relating to certain staff-to-child ratios applicable to | ||
nonresidential child-care facilities. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 42.042, Human Resources Code, is amended | ||
by adding Subsection (m-1) to read as follows: | ||
(m-1) In determining the minimum standards relating to | ||
staff-to-child ratios applicable to nonresidential child-care | ||
facilities that provide care for less than 24 hours a day, the | ||
department may not establish a staff-to-child ratio that exceeds: | ||
(1) one staff member per nine children who are two | ||
years of age; and | ||
(2) one staff member per 14 children who are three | ||
years of age. | ||
SECTION 2. Not later than December 1, 2013, the executive | ||
commissioner of the Health and Human Services Commission shall | ||
adopt any rules necessary to implement Section 42.042(m-1), Human | ||
Resources Code, as added by this Act. | ||
SECTION 3. This Act takes effect September 1, 2013. |
