BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 15, Penal Code, is amended by adding | ||
Section 15.021 to read as follows: | ||
Sec. 15.021. CRIMINAL PURSUIT. (a) A person commits an | ||
offense if, with the intent to commit an offense under Chapter 29, | ||
an offense under Section 30.04 involving theft, or an offense under | ||
Section 31.03, the person: | ||
(1) knowingly travels from a commercial business or | ||
financial institution, as defined by Section 201.101, Finance Code, | ||
on the same path or route as another person without substantially | ||
deviating from that path or route; | ||
(2) is a member of a criminal street gang, as defined | ||
by Section 71.01; and | ||
(3) is in possession of two or more criminal | ||
instruments, as defined by Section 16.01. | ||
(b) An offense under this section is a felony of the third | ||
degree. | ||
(c) If conduct constituting an offense under this section | ||
also constitutes an offense under another section of this code, the | ||
actor may be prosecuted under either section or under both | ||
sections. | ||
SECTION 2. This Act takes effect September 1, 2025. |
