| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 1213.005, Insurance Code, is amended to | ||
| read as follows: | ||
| Sec. 1213.005. CERTAIN CHARGES PROHIBITED. A health | ||
| benefit plan or a third-party administrator or pharmacy benefit | ||
| manager acting on behalf of the health benefit plan may not directly | ||
| or indirectly charge or hold a health care professional, health | ||
| care facility, or person enrolled in a health benefit plan | ||
| responsible for a fee for the adjudication of a claim. | ||
| SECTION 2. This Act applies only to a claim submitted on or | ||
| after September 1, 2013. A claim submitted before September 1, | ||
| 2013, is governed by the law as it existed immediately before that | ||
| date, and that law is continued in effect for that purpose. | ||
| SECTION 3. This Act takes effect September 1, 2013. | ||
