| relating to the applicability of certain laws to assistance | ||
| provided to an individual in obtaining an abortion outside of this | ||
| state. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 170A.002, Health and Safety Code, is | ||
| amended by adding Subsection (e) to read as follows: | ||
| (e) Direct or indirect assistance provided to an individual | ||
| for traveling outside of this state to obtain an abortion does not | ||
| constitute a violation of this section. | ||
| SECTION 2. Subchapter A, Chapter 171, Health and Safety | ||
| Code, is amended by adding Section 171.009 to read as follows: | ||
| Sec. 171.009. ASSISTANCE WITH OUT-OF-STATE TRAVEL. | ||
| Notwithstanding any other law, a person may provide direct or | ||
| indirect assistance to an individual for traveling outside of this | ||
| state to obtain an abortion. | ||
| SECTION 3. Section 171.208, Health and Safety Code, is | ||
| amended by adding Subsection (a-1) to read as follows: | ||
| (a-1) A civil action under Subsection (a)(2) or (3) may not | ||
| be brought against a person for providing or intending to provide | ||
| direct or indirect assistance to an individual for traveling | ||
| outside of this state to obtain an abortion. | ||
| SECTION 4. This Act takes effect September 1, 2023. | ||
