A BILL TO BE ENTITLED
 
AN ACT
  relating to the publication of a list of certain residential
  property claimed without record title.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Title 2, Property Code, is amended by adding
  Chapter 6 to read as follows:
  CHAPTER 6.  RESIDENTIAL PROPERTY CLAIMED WITHOUT RECORD TITLE
         Sec. 6.001.  APPLICABILITY. This chapter applies only to
  residential property if:
               (1)  a person who may be entitled to claim an ownership
  interest in the property cannot be located after a reasonable
  effort; and
               (2)  ownership of the property is established under
  Section 2306.188, Government Code.
         Sec. 6.002.  PROPERTY REPORT. (a)  For residential property
  for which ownership is established during the one-year period
  preceding June 30 of each year, the Texas Department of Housing and
  Community Affairs shall file a report with the comptroller on or
  before the following November 1.
         (b)  The property report must include:
               (1)  the address of the residential property;
               (2)  the name of each person establishing ownership
  under Section 2306.188, Government Code; and
               (3)  the name of each person who may be entitled to
  claim an ownership interest in the property.
         Sec. 6.003.  LIST OF OWNERS. (a)  Each year, the comptroller
  shall compile and revise an alphabetical list of the names and
  addresses reported to the comptroller under Section 6.002.
         (b)  The comptroller shall make the list available on the
  Internet.
         (c)  The comptroller shall remove a name or address
  associated with a property from the list on request of a person who
  establishes record title to the property.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
