| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 48.105(b), Education Code, is amended to | ||
| read as follows: | ||
| (b) At least 55 percent of the funds allocated under this | ||
| section must be used in providing bilingual education or special | ||
| language programs under Subchapter B, Chapter 29. A district's | ||
| bilingual education or special language allocation may be used only | ||
| for program and student evaluation, instructional materials and | ||
| equipment, staff development, supplemental staff expenses, salary | ||
| or salary supplements for teachers, incremental costs associated | ||
| with providing smaller class sizes, and other supplies required for | ||
| quality instruction. | ||
| SECTION 2. This Act applies beginning with the 2021-2022 | ||
| school year. | ||
| SECTOIN 3. This Act takes effect immediately if it receives a | ||
| vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2021. | ||
