relating to the procedure for adoption by a state agency of rules | ||
that may have an adverse economic effect on small businesses, | ||
micro-businesses, and rural communities. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 2006.002, Government Code, is amended by | ||
adding Subsection (h) to read as follows: | ||
(h) If a state agency is made aware that a proposed rule may | ||
have an adverse economic effect on small businesses, | ||
micro-businesses, or rural communities, as applicable, after | ||
notice of the proposed rule has been published, the agency shall: | ||
(1) prepare an economic impact statement and a | ||
regulatory flexibility analysis as required under Subsections (c) | ||
and (c-1); | ||
(2) publish the statement and the analysis in the | ||
Texas Register as an amendment to the proposed rule; and | ||
(3) provide a copy of the statement and the analysis to | ||
the standing committee of each house of the legislature charged | ||
with reviewing the proposed rule. | ||
SECTION 2. The changes in law made by this Act to Section | ||
2006.002, Government Code, apply only to a rule proposed by a state | ||
agency on or after the effective date of this Act. A rule proposed | ||
by a state agency before the effective date of this Act is governed | ||
by the law in effect on the date the rule was proposed, and the | ||
former law is continued in effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2021. |
