relating to the establishment of limited purpose public junior | ||
college districts by certain independent school districts. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 130.011, Education Code, is amended by | ||
adding Subsection (c) to read as follows: | ||
(c) An independent school district located in a county with | ||
a population of less than 45,000 that does not meet the scholastic | ||
population requirements of Section 130.032 may establish a limited | ||
purpose junior college district under this subchapter to meet the | ||
career and technical interests of students and employers in the | ||
district. A limited purpose junior college district is not | ||
required to provide the programs described by Section | ||
130.003(e)(4), (5), or (8). | ||
SECTION 2. Section 130.017, Education Code, is amended by | ||
adding Subsection (e) to read as follows: | ||
(e) For a limited purpose junior college district | ||
established under Section 130.011(c), the proposition described by | ||
Subsection (b) must provide that the junior college district may | ||
not levy ad valorem taxes at a rate that, when combined with the | ||
rate charged by the independent school district, exceeds the rate | ||
charged by the independent school district before the board of | ||
trustees divested its authority as governing board of the junior | ||
college district. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2015. |
