| relating to the expiration of a county burn ban. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subsection (e), Section 352.081, Local | ||
| Government Code, is amended to read as follows: | ||
| (e) An order adopted under this section expires, as | ||
| applicable, on the date: | ||
| (1) a determination is made under Subsection (b) that | ||
| drought conditions no longer exist; or | ||
| (2) a determination is made by the commissioners | ||
| court, or the county judge or fire marshal if designated for that | ||
| purpose by the commissioners court, that the circumstances | ||
| identified under Subsection (c)(2) no longer exist. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2011. | ||
