| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter A, Chapter 5, Property Code, is | ||
| amended by adding Section 5.0025 to read as follows: | ||
| Sec. 5.0025. WITNESSES TO CONVEYANCE REQUIRED. An | ||
| instrument intended as a conveyance of real property or an interest | ||
| in real property is invalid unless the instrument is attested by two | ||
| or more credible witnesses who are at least 14 years of age and who | ||
| subscribe their names to the instrument in their own handwriting in | ||
| the grantor's presence. | ||
| SECTION 2. Section 5.0025, Property Code, as added by this | ||
| Act, applies only to an instrument executed on or after the | ||
| effective date of this Act. An instrument executed before the | ||
| effective date of this Act is governed by the law as it existed | ||
| immediately before the effective date of this Act, and that law is | ||
| continued in effect for that purpose. | ||
| SECTION 3. This Act takes effect September 1, 2021. | ||
