relating to requiring witnesses to sign an instrument conveying | ||
real property interest. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter A, Chapter 5, Property Code, is | ||
amended by adding Section 5.0025 to read as follows: | ||
Sec. 5.0025. WITNESSES TO CONVEYANCE REQUIRED. An | ||
instrument intended as a conveyance of real property or an interest | ||
in real property is invalid unless the instrument is attested by two | ||
or more credible witnesses who are at least 14 years of age and who | ||
subscribe their names to the instrument in their own handwriting in | ||
the grantor's presence. | ||
SECTION 2. Section 5.0025, Property Code, as added by this | ||
Act, applies only to an instrument executed on or after the | ||
effective date of this Act. An instrument executed before the | ||
effective date of this Act is governed by the law as it existed | ||
immediately before the effective date of this Act, and that law is | ||
continued in effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2021. |
