creating an offense. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 46, Penal Code, is amended by adding | ||
Section 46.16 to read as follow: | ||
Sec. 46.16. UNLAWFUL AMMO. (a) It shall be unlawful for any | ||
person to use or possess any expanding bullet. | ||
(b) Any person found in violation of this section shall be | ||
guilty of a Class A misdemeanor. | ||
(c) In this Section, "expanding bullet" means any | ||
projectile designed to expand or fragment upon impact. | ||
(d) Subsection (a) does not apply to: | ||
(1) Law enforcement officers, members of the military, | ||
or other persons authorized by law to possess expanding bullets in | ||
the course of their official duties; or | ||
(2) The possession of expanding bullets for scientific | ||
research or educational purposes, provided that the possession is | ||
authorized by law. | ||
SECTION 2. This Act takes effect September 1, 2023. |
