A BILL TO BE ENTITLED
 
AN ACT
  relating to a study conducted by the School Health Advisory
  Committee regarding commercial advertisements on public school
  property.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  (a) In this Act:
               (1)  "Committee" means the School Health Advisory
  Committee established under Section 1001.0711, Health and Safety
  Code.
               (2)  "Public school property" means any property owned
  by a public school. The term includes buildings, vehicles, lockers,
  school buses, and real property, including football fields.
         (b)  The committee shall conduct a study regarding the use of
  commercial advertisements on public school property.
         (c)  Not later than December 1, 2014, the committee shall
  submit a report regarding the results of the study to the Department
  of State Health Services, the Department of Agriculture, the house
  committee on public health, the senate committee on health and
  human services, the house committee on public education, and the
  senate committee on education. The report must include:
               (1)  an economic impact statement that estimates the
  financial benefit to public schools of placing commercial
  advertisements on public school property;
               (2)  an assessment of the types of and content of
  commercial advertisements found on public school property;
               (3)  a description of the restrictions or rules
  affecting a commercial entity's ability to advertise on public
  school property;
               (4)  an evaluation of the different messages conveyed
  by commercial advertisements on public school property; and
               (5)  an assessment of the frequency with which food is
  advertised on public school property and of the types of healthy and
  unhealthy food options that are advertised on public school
  property.
         (d)  This Act expires January 1, 2015.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
