relating to a requirement that each public institution of higher | ||
education develop and implement a strategic plan for the prevention | ||
of sexual assault and unplanned pregnancy. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter Z, Chapter 51, Education Code, is | ||
amended by adding Section 51.9364 to read as follows: | ||
Sec. 51.9364. STRATEGIC PLAN FOR PREVENTION OF SEXUAL | ||
ASSAULT AND UNPLANNED PREGNANCY. (a) In this section, | ||
"institution of higher education" has the meaning assigned by | ||
Section 61.003. | ||
(b) Each institution of higher education shall develop and | ||
implement a strategic plan for the prevention of sexual assault on | ||
the institution's campus and unplanned pregnancy among the students | ||
enrolled at the institution. | ||
(c) The strategic plan must: | ||
(1) identify opportunities for raising awareness | ||
among, and providing information and resources to, students | ||
regarding campus sexual assault and unplanned pregnancy | ||
prevention, including through: | ||
(A) the use of special events, presentations, and | ||
training sessions for students and student organizations; and | ||
(B) the integration of educational information | ||
into student orientation programs provided to new students and | ||
counseling or advising services provided to continuing students; | ||
and | ||
(2) be approved by the institution's governing board | ||
before final adoption by the institution. | ||
(d) Each biennium, each institution of higher education | ||
shall review the institution's strategic plan and, with approval of | ||
the institution's governing board, revise the plan as necessary. | ||
(e) In consultation with institutions of higher education, | ||
the Texas Higher Education Coordinating Board shall adopt any rules | ||
the coordinating board considers appropriate for the | ||
administration of this section. | ||
SECTION 2. Not later than January 1, 2018, the Texas Higher | ||
Education Coordinating Board shall adopt the rules required by | ||
Section 51.9364, Education Code, as added by this Act. | ||
SECTION 3. Not later than September 1, 2018, each public | ||
institution of higher education shall develop and implement the | ||
strategic plan required by Section 51.9364, Education Code, as | ||
added by this Act. | ||
SECTION 4. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2017. |
