| relating to a requirement that each public institution of higher | ||
| education develop and implement a strategic plan for the prevention | ||
| of sexual assault and unplanned pregnancy. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter Z, Chapter 51, Education Code, is | ||
| amended by adding Section 51.9364 to read as follows: | ||
| Sec. 51.9364. STRATEGIC PLAN FOR PREVENTION OF SEXUAL | ||
| ASSAULT AND UNPLANNED PREGNANCY. (a) In this section, | ||
| "institution of higher education" has the meaning assigned by | ||
| Section 61.003. | ||
| (b) Each institution of higher education shall develop and | ||
| implement a strategic plan for the prevention of sexual assault on | ||
| the institution's campus and unplanned pregnancy among the students | ||
| enrolled at the institution. | ||
| (c) The strategic plan must: | ||
| (1) identify opportunities for raising awareness | ||
| among, and providing information and resources to, students | ||
| regarding campus sexual assault and unplanned pregnancy | ||
| prevention, including through: | ||
| (A) the use of special events, presentations, and | ||
| training sessions for students and student organizations; and | ||
| (B) the integration of educational information | ||
| into student orientation programs provided to new students and | ||
| counseling or advising services provided to continuing students; | ||
| and | ||
| (2) be approved by the institution's governing board | ||
| before final adoption by the institution. | ||
| (d) Each biennium, each institution of higher education | ||
| shall review the institution's strategic plan and, with approval of | ||
| the institution's governing board, revise the plan as necessary. | ||
| (e) In consultation with institutions of higher education, | ||
| the Texas Higher Education Coordinating Board shall adopt any rules | ||
| the coordinating board considers appropriate for the | ||
| administration of this section. | ||
| SECTION 2. Not later than January 1, 2018, the Texas Higher | ||
| Education Coordinating Board shall adopt the rules required by | ||
| Section 51.9364, Education Code, as added by this Act. | ||
| SECTION 3. Not later than September 1, 2018, each public | ||
| institution of higher education shall develop and implement the | ||
| strategic plan required by Section 51.9364, Education Code, as | ||
| added by this Act. | ||
| SECTION 4. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2017. | ||
