| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter F, Chapter 304, Business & Commerce | ||
| Code, is amended by adding Section 304.260 to read as follows: | ||
| Sec. 304.260. CRIMINAL PENALTY. (a) A person who violates | ||
| Section 304.052 commits an offense. | ||
| (b) An offense under this section is a Class B misdemeanor, | ||
| except that the offense is a Class A misdemeanor if it is shown on | ||
| the trial of the offense that the person has been previously | ||
| convicted of an offense under this section. | ||
| SECTION 2. This Act takes effect September 1, 2019. | ||
