A BILL TO BE ENTITLED
 
AN ACT
  relating to an adjustment of the average daily attendance of a
  school district with a certain student attendance rate.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 48.005, Education Code, is amended by
  adding Subsection (a-1) to read as follows:
         (a-1)  Notwithstanding any other adjustment to average daily
  attendance to which a school district may be entitled under this
  section, for a school year in which a district's student attendance
  rate is less than the average of the district's student attendance
  rate for the preceding three school years, the commissioner shall
  adjust the average daily attendance of the district by multiplying
  the district's average daily attendance by an amount equal to the
  quotient of the average of the district's student attendance rate
  for the preceding three school years divided by the district's
  student attendance rate. For purposes of this subsection:
               (1)  the district's student attendance rate is the
  quotient of the sum of attendance by students in membership for
  purposes of average daily attendance for each day of the minimum
  number of days of instruction as described under Section 25.081(a)
  divided by the sum of the number of days of the minimum number of
  days of instruction for which those students are in membership; and
               (2)  in calculating the district's student attendance
  rate for the preceding three school years, the commissioner shall
  use the three most recent preceding school years excluding any
  school year during which a statewide disaster declaration was
  issued by the governor under Chapter 418, Government Code.
         SECTION 2.  This Act takes effect September 1, 2023.
