| relating to an adjustment of the average daily attendance of a | ||
| school district with a certain student attendance rate. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 48.005, Education Code, is amended by | ||
| adding Subsection (a-1) to read as follows: | ||
| (a-1) Notwithstanding any other adjustment to average daily | ||
| attendance to which a school district may be entitled under this | ||
| section, for a school year in which a district's student attendance | ||
| rate is less than the average of the district's student attendance | ||
| rate for the preceding three school years, the commissioner shall | ||
| adjust the average daily attendance of the district by multiplying | ||
| the district's average daily attendance by an amount equal to the | ||
| quotient of the average of the district's student attendance rate | ||
| for the preceding three school years divided by the district's | ||
| student attendance rate. For purposes of this subsection: | ||
| (1) the district's student attendance rate is the | ||
| quotient of the sum of attendance by students in membership for | ||
| purposes of average daily attendance for each day of the minimum | ||
| number of days of instruction as described under Section 25.081(a) | ||
| divided by the sum of the number of days of the minimum number of | ||
| days of instruction for which those students are in membership; and | ||
| (2) in calculating the district's student attendance | ||
| rate for the preceding three school years, the commissioner shall | ||
| use the three most recent preceding school years excluding any | ||
| school year during which a statewide disaster declaration was | ||
| issued by the governor under Chapter 418, Government Code. | ||
| SECTION 2. This Act takes effect September 1, 2023. | ||
