during a legislative session. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter C, Chapter 571, Government Code, is | ||
amended by adding Section 571.080 to read as follows: | ||
Sec. 571.080. RANDOM DRUG TESTING OF LEGISLATORS. (a) In | ||
this section, "controlled substance" and "marihuana" have the | ||
meanings assigned by Chapter 481, Health and Safety Code. | ||
(b) The commission by rule shall establish a program to | ||
randomly test members of the legislature for the use of controlled | ||
substances and marihuana during a legislative session. The program | ||
must provide for the random, unannounced drug testing of each | ||
member at times determined by the commission during a legislative | ||
session. The commission shall post on the commission's Internet | ||
website the results of each drug test or, if applicable, a statement | ||
that the member refused to comply with the commission's request for | ||
drug testing. | ||
SECTION 2. Not later than January 1, 2020, the Texas Ethics | ||
Commission shall adopt rules as necessary to implement Section | ||
571.080, Government Code, as added by this Act. | ||
SECTION 3. This Act takes effect September 1, 2019. |
