| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter C, Chapter 571, Government Code, is | ||
| amended by adding Section 571.080 to read as follows: | ||
| Sec. 571.080. RANDOM DRUG TESTING OF LEGISLATORS. (a) In | ||
| this section, "controlled substance" and "marihuana" have the | ||
| meanings assigned by Chapter 481, Health and Safety Code. | ||
| (b) The commission by rule shall establish a program to | ||
| randomly test members of the legislature for the use of controlled | ||
| substances and marihuana during a legislative session. The program | ||
| must provide for the random, unannounced drug testing of each | ||
| member at times determined by the commission during a legislative | ||
| session. The commission shall post on the commission's Internet | ||
| website the results of each drug test or, if applicable, a statement | ||
| that the member refused to comply with the commission's request for | ||
| drug testing. | ||
| SECTION 2. Not later than January 1, 2020, the Texas Ethics | ||
| Commission shall adopt rules as necessary to implement Section | ||
| 571.080, Government Code, as added by this Act. | ||
| SECTION 3. This Act takes effect September 1, 2019. | ||
