| stock; creating a criminal offense;. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 46, Penal Code, is amended by adding new | ||
| Section 46.16 to read as follow: | ||
| Sec. 46.16. BUMP-STOCK CONVERSION KITS PROHIBITED. (a) A | ||
| person may not import into this state or transfer, distribute, | ||
| sell, keep for sale, offer for sale, possess, or give to another | ||
| person a bump-fire stock. | ||
| (b) A person who violates this section commits a Class A | ||
| Misdemeanor. | ||
| (c) As used in this section, the term "bump-fire stock" | ||
| means a conversion kit, a tool, an accessory, or a device used to | ||
| alter the rate of fire of a firearm to mimic automatic weapon fire | ||
| or which is used to increase the rate of fire to a faster rate than | ||
| is possible for a person to fire such semiautomatic firearm | ||
| unassisted by a kit, a tool, an accessory, or a device. | ||
| SECTION 2. The changes in law made by this Act apply only to | ||
| an offense committed on or after the effective date of this Act. An | ||
| offense committed before the effective date of this Act is governed | ||
| by the law in effect on the date the offense was committed, and the | ||
| former law is continued in effect for that purpose. For purposes of | ||
| this subsection, an offense was committed before the effective date | ||
| of this Act if any element of the offense was committed before that | ||
| date. | ||
| SECTION 3. This Act takes effect September 1, 2023. | ||
