| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 214, Labor Code, is amended by adding | ||
| Section 214.0025 to read as follows: | ||
| Sec. 214.0025. LIABILITY FOR OBTAINING BENEFITS PAID IN | ||
| ERROR. A person who has received benefits to which the person was | ||
| not entitled that were paid to the person solely due to commission | ||
| error is not liable for the amount of those benefits. The | ||
| commission may not seek to recover the amount of those benefits from | ||
| the person. | ||
| SECTION 2. Section 214.0025, Labor Code, as added by this | ||
| Act, applies to benefits paid before, on, or after the effective | ||
| date of this Act. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2021. | ||
