relating to the transmission of water across two or more county | ||
lines for the purpose of providing wholesale water service. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 13, Water Code, is amended by adding | ||
Subchapter O to read as follows: | ||
SUBCHAPTER O. TRANSMISSION OF WATER FOR WHOLESALE SERVICE | ||
Sec. 13.551. WHOLESALE TRANSMISSION PIPELINE IN THREE OR | ||
MORE COUNTIES. (a) This section applies only to transmission of | ||
water by a pipeline of more than 24 inches in diameter. | ||
(b) A person may transmit potable water by pipeline across | ||
two or more county lines for the purpose of providing wholesale | ||
water service only if the person is a local government corporation | ||
created under Subchapter D, Chapter 431, Transportation Code, to | ||
aid and act on behalf of the counties through which the pipeline | ||
travels. | ||
SECTION 2. Section 13.551, Water Code, as added by this Act, | ||
applies only to a pipeline that begins to be used for providing | ||
wholesale water service on or after the effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2021. |
