relating to prohibiting the use of state or federal money for the | ||
purpose of certain instruction at public institutions of higher | ||
education. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter Z, Chapter 51, Education Code, is | ||
amended by adding Section 51.979 to read as follows: | ||
Sec. 51.979. USE OF STATE OR FEDERAL MONEY PROHIBITED FOR | ||
CERTAIN INSTRUCTION. (a) In this section, "institution of higher | ||
education" has the meaning assigned by Section 61.003. | ||
(b) Notwithstanding any other law, an institution of higher | ||
education may not use appropriated state or federal money to offer a | ||
course, component of a course, unit of study, or other instruction | ||
that directs or otherwise compels a student to personally affirm, | ||
adopt, or adhere to the idea that: | ||
(1) any race, sex, ethnicity, religion, color, or | ||
national origin is inherently superior or inferior to another race, | ||
sex, ethnicity, religion, color, or national origin; | ||
(2) an individual should be discriminated against or | ||
receive adverse treatment solely or partly because of the | ||
individual's race, sex, ethnicity, religion, color, or national | ||
origin; or | ||
(3) an individual, by virtue of the individual's race, | ||
sex, ethnicity, religion, color, or national origin, is inherently | ||
responsible for actions committed in the past by other members of | ||
the same race, sex, ethnicity, religion, color, or national origin. | ||
SECTION 2. This Act applies beginning with the 2022 spring | ||
semester. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect on the 91st day after the last day of the | ||
legislative session. |
