A BILL TO BE ENTITLED
 
AN ACT
  relating to the administrative fee charged for the collection of an
  unpaid toll.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 366.178(c), Transportation Code, is
  amended to read as follows:
         (c)  If a person fails to pay the proper toll:
               (1)  on issuance of a notice of nonpayment, the
  registered owner of the nonpaying vehicle shall pay both the proper
  toll and the administrative fee; and
               (2)  an authority may charge an administrative fee of
  not more than $50 [$100] to recover the cost of collecting the
  unpaid toll.
         SECTION 2.  The change in law made by this Act to Section
  366.178(c), Transportation Code, does not affect fees imposed
  before the effective date of this Act, and the law in effect before
  that date is continued in effect for purposes of the liability for
  and collection of those fees.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
