| relating to proof of United States citizenship for the issuance or | ||
| renewal of a personal automobile insurance policy. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 1951, Insurance Code, is amended by | ||
| adding Section 1951.005 to read as follows: | ||
| Sec. 1951.005. PROOF OF CITIZENSHIP REQUIRED. An insurer, | ||
| including a county mutual insurance company, may not deliver, issue | ||
| for delivery, or renew in this state a personal automobile | ||
| insurance policy unless the proposed insured provides to the | ||
| insurer one of the following documents as proof of United States | ||
| citizenship: | ||
| (1) an unexpired passport issued to the insured; | ||
| (2) a certified copy of a birth certificate or other | ||
| document confirming the insured's birth that is admissible in a | ||
| court of law and establishes the insured's identity; or | ||
| (3) United States citizenship papers issued to the | ||
| insured. | ||
| SECTION 2. The change in law made by this Act applies only | ||
| to a personal automobile insurance policy that is delivered, issued | ||
| for delivery, or renewed on or after January 1, 2026. | ||
| SECTION 3. This Act takes effect September 1, 2025. | ||
