AN ACT
  relating to the Texas State Board of Pharmacy.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subsection (a), Section 552.001, Occupations
  Code, is amended to read as follows:
         (a)  The Texas State Board of Pharmacy consists of 11 [nine]
  members appointed by the governor with the advice and consent of the
  senate as follows:
               (1)  seven [six] members who are pharmacists; [and]
               (2)  one member who is a pharmacy technician; and
               (3)  three members who represent the public.
         SECTION 2.  Section 552.002, Occupations Code, is amended by
  adding Subsection (b-1) to read as follows:
         (b-1)  A pharmacy technician board member must, at the time
  of appointment:
               (1)  be a resident of this state;
               (2)  have been registered as a pharmacy technician for
  the five years preceding appointment;
               (3)  be in good standing to act as a pharmacy technician
  in this state; and
               (4)  be acting as a pharmacy technician in this state.
         SECTION 3.  Subsection (a), Section 552.005, Occupations
  Code, is amended to read as follows:
         (a)  Members of the board are appointed for staggered
  six-year terms, with either[. The terms of] three or four members'
  terms, as applicable, expiring [members expire] every other year at
  midnight on the last day of the state fiscal year in the last year of
  the member's term.
         SECTION 4.  Subsection (a), Section 552.010, Occupations
  Code, is amended to read as follows:
         (a)  The board shall meet at least[:
               [(1)]  once every four months to transact board
  business[; and
               [(2)     twice each year for the examination of
  applicants].
         SECTION 5.  As soon as practicable after the effective date
  of this Act, the governor shall appoint a pharmacy technician and a
  pharmacist to the Texas State Board of Pharmacy as required by this
  Act.  In appointing the members, the governor shall appoint:
               (1)  a pharmacy technician to a term expiring August
  31, 2019; and
               (2)  a pharmacist to a term expiring August 31, 2017.
         SECTION 6.  This Act takes effect September 1, 2013.
