relating to the regulation of package store permit holders. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 22.06, Alcoholic Beverage Code, is | ||
amended to read as follows: | ||
Sec. 22.06. PROHIBITED INTERESTS. (a) Except as otherwise | ||
provided in Section 102.05 of this code and in Subsection (b) of | ||
this section, no person who holds a package store permit or owns an | ||
interest in a package store may have a direct or indirect interest | ||
in any of the following: | ||
(1) a manufacturer's, retail dealer's on-premise, or | ||
general, branch, or local distributor's license; | ||
(2) a wine and beer retailer's[ |

(3) the business of any of the permits or licenses | ||
listed in Subdivisions (1) and (2) of this subsection. | ||
(b) A package store permit and a retail dealer's off-premise | ||
license or a wine and beer retailer's off-premise permit may be | ||
issued to the same person. | ||
SECTION 2. Section 22.14(d), Alcoholic Beverage Code, is | ||
amended to read as follows: | ||
(d) Subsections (a) and [ |

to a package store that qualifies for exemption under Section 11.50 | ||
or to a package store in a hotel that qualifies for exemption under | ||
Section 102.05. | ||
SECTION 3. Sections 22.04, 22.05, 22.14(c), and 22.16, | ||
Alcoholic Beverage Code, are repealed. | ||
SECTION 4. This Act takes effect September 1, 2015. |
