A BILL TO BE ENTITLED
 
AN ACT
  relating to the prohibition of lane restrictions on a portion of
  Interstate Highway 635.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  The heading to Subchapter E, Chapter 228,
  Transportation Code, is amended to read as follows:
         SUBCHAPTER E. LIMITATION ON TOLL FACILITY DESIGNATION, TOLL
  COLLECTION, LANE RESTRICTIONS, AND[;] CONVERSION OF NONTOLLED
  STATE HIGHWAY
         SECTION 2.  Subchapter E, Chapter 228, Transportation Code,
  is amended by adding Section 228.208 to read as follows:
         Sec. 228.208.  LANE RESTRICTIONS ON PORTION OF INTERSTATE
  HIGHWAY 635 PROHIBITED. Notwithstanding any other provision of
  this subtitle, the department may not place a lane restriction,
  including charging a toll or implementing managed lanes, either
  directly or indirectly through an agreement with another entity, on
  the portion of Interstate Highway 635 between its intersection with
  Interstate Highway 30 and its intersection with U.S. Highway 75.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2025.
