A BILL TO BE ENTITLED
 
AN ACT
  relating to a prohibition on requiring a local government to
  provide compensation to the Texas Department of Transportation for
  certain potential or actual lost toll project revenue.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 228, Transportation Code, is amended by
  adding Section 228.0032 to read as follows:
         Sec. 228.0032.  PROHIBITION ON COMPENSATION FOR POTENTIAL OR
  ACTUAL LOST TOLL PROJECT REVENUE. The department may not require a
  local government, as defined by Section 228.0031, to provide
  monetary compensation to the department or to otherwise bear the
  cost of potential or actual lost toll project revenue resulting
  from the construction, improvement, or use of adjacent nontolled
  lanes or other road infrastructure that may compete with a toll
  project.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2025.
