BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 483.102, Health and Safety Code, is | ||
amended by adding Subsections (a-1) and (d) to read as follows: | ||
(a-1) The commissioner of state health services or, if the | ||
commissioner is not a physician, the chief medical executive of the | ||
Department of State Health Services shall issue a statewide | ||
standing order prescribing an opioid antagonist to a person | ||
described by Subsection (a)(1) or (2). | ||
(d) The commissioner or the chief medical executive who | ||
prescribes an opioid antagonist under a standing order as required | ||
under Subsection (a-1) has official immunity and may not be subject | ||
to any criminal or civil liability for: | ||
(1) issuing the standing order prescribing the opioid | ||
antagonist; or | ||
(2) any outcome resulting from the eventual | ||
administration of the opioid antagonist. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2023. |
