A BILL TO BE ENTITLED
 
AN ACT
  relating to a statewide standing order prescribing opioid
  antagonists.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 483.102, Health and Safety Code, is
  amended by adding Subsections (a-1) and (d) to read as follows:
         (a-1)  The commissioner of state health services or, if the
  commissioner is not a physician, the chief medical executive of the
  Department of State Health Services shall issue a statewide
  standing order prescribing an opioid antagonist to a person
  described by Subsection (a)(1) or (2).
         (d)  The commissioner or the chief medical executive who
  prescribes an opioid antagonist under a standing order as required
  under Subsection (a-1) has official immunity and may not be subject
  to any criminal or civil liability for:
               (1)  issuing the standing order prescribing the opioid
  antagonist; or
               (2)  any outcome resulting from the eventual
  administration of the opioid antagonist.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
