relating to the licensing of and requirements for certain | ||
child-care facilities that detain certain children. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter C, Chapter 42, Human Resources Code, | ||
is amended by adding Section 42.0415 to read as follows: | ||
Sec. 42.0415. STANDARD LICENSE REQUIREMENTS; WAIVER | ||
PROHIBITED. (a) The commission shall issue or renew a license of a | ||
child-care facility that is operated by or under a contract with | ||
United States Immigration and Customs Enforcement to enforce | ||
federal immigration laws and that detains children, in the same | ||
manner and subject to the same requirements as the commission | ||
issues or renews a license for any other child-care facility under | ||
this chapter. | ||
(b) The commission may not waive any licensing requirement, | ||
including minimum standards, for a child-care facility described by | ||
Subsection (a). | ||
SECTION 2. Section 42.0415, Human Resources Code, as added | ||
by this Act, applies only to a license issued or renewed on or after | ||
the effective date of this Act. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2019. |
