proposing a constitutional amendment to change the length of the | ||
unexpired term that causes the automatic resignation of certain | ||
elected county or district officeholders if they become candidates | ||
for another office. | ||
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 65(b), Article XVI, Texas Constitution, | ||
is amended to read as follows: | ||
(b) If any of the officers named herein shall announce their | ||
candidacy, or shall in fact become a candidate, in any General, | ||
Special or Primary Election, for any office of profit or trust under | ||
the laws of this State or the United States other than the office | ||
then held, at any time when the unexpired term of the office then | ||
held shall exceed one year and 60 [ |

such candidacy shall constitute an automatic resignation of the | ||
office then held, and the vacancy thereby created shall be filled | ||
pursuant to law in the same manner as other vacancies for such | ||
office are filled. | ||
SECTION 2. This proposed constitutional amendment shall be | ||
submitted to the voters at an election to be held November 5, 2013. | ||
The ballot shall be printed to provide for voting for or against the | ||
proposition: "The constitutional amendment to change the length of | ||
the unexpired term that causes the automatic resignation of certain | ||
elected county or district officeholders if they become candidates | ||
for another office." |
