proposing a constitutional amendment to authorize the legislature | ||

state of disaster or emergency declared by the governor. | ||
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article III, Texas Constitution, is amended by | ||
adding Section 42 to read as follows: | ||
Sec. 42. (a) Notwithstanding Section 40 of this article, | ||
the legislature may review and terminate during a regular or | ||
special session an order issued by the governor during a state of | ||
disaster or emergency declared by the governor. The legislature may | ||
terminate the order by passage of a resolution approved by a | ||
majority vote of the members present in each house of the | ||
legislature. | ||
(b) A vote under Subsection (a) of this section is not | ||
subject to Section 15, Article IV, of this constitution. | ||
SECTION 2. This proposed constitutional amendment shall be | ||
submitted to the voters at an election to be held November 2, 2021. | ||
The ballot shall be printed to permit voting for or against the | ||
proposition: "The constitutional amendment to authorize the | ||
legislature to review and terminate an order issued by the governor | ||
during a state of disaster or emergency declared by the governor." |
