| proposing a constitutional amendment to authorize the legislature | ||

| state of disaster or emergency declared by the governor. | ||
| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Article III, Texas Constitution, is amended by | ||
| adding Section 42 to read as follows: | ||
| Sec. 42. (a) Notwithstanding Section 40 of this article, | ||
| the legislature may review and terminate during a regular or | ||
| special session an order issued by the governor during a state of | ||
| disaster or emergency declared by the governor. The legislature may | ||
| terminate the order by passage of a resolution approved by a | ||
| majority vote of the members present in each house of the | ||
| legislature. | ||
| (b) A vote under Subsection (a) of this section is not | ||
| subject to Section 15, Article IV, of this constitution. | ||
| SECTION 2. This proposed constitutional amendment shall be | ||
| submitted to the voters at an election to be held November 2, 2021. | ||
| The ballot shall be printed to permit voting for or against the | ||
| proposition: "The constitutional amendment to authorize the | ||
| legislature to review and terminate an order issued by the governor | ||
| during a state of disaster or emergency declared by the governor." | ||
