proposing a constitutional amendment requiring the state to expand | ||
eligibility for the Medicaid program to certain persons. | ||
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article XVI, Texas Constitution, is amended by | ||
adding Section 74 to read as follows: | ||
Sec. 74. The state shall provide medical assistance under | ||
the federal Medicaid program to all persons who apply for that | ||
assistance and for whom federal matching funds are available under | ||
the Patient Protection and Affordable Care Act (Pub. L. No. | ||
111-148) as amended by the Health Care and Education Reconciliation | ||
Act of 2010 (Pub. L. No. 111-152) to the state to provide that | ||
assistance. | ||
SECTION 2. The following temporary provision is added to | ||
the Texas Constitution: | ||
TEMPORARY PROVISION. (a) This temporary provision applies | ||
to the constitutional amendment proposed by the 83rd Legislature, | ||
Regular Session, 2013, requiring the state to expand eligibility | ||
for the Medicaid program to all persons for whom federal matching | ||
funds are available under the federal Patient Protection and | ||
Affordable Care Act. | ||
(b) Section 74, Article XVI, of this constitution takes | ||
effect January 1, 2014. | ||
(c) This temporary provision expires January 1, 2015. | ||
SECTION 3. This proposed constitutional amendment shall be | ||
submitted to the voters at an election to be held November 5, 2013. | ||
The ballot shall be printed to provide for voting for or against the | ||
proposition: "The constitutional amendment requiring the state to | ||
expand eligibility for the Medicaid program to all persons for whom | ||
federal matching funds are available under the federal Patient | ||
Protection and Affordable Care Act." |
