Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 55-510.3:1 as follows:

§55-510.3:1. Inspection and maintenance of stormwater management facilities.

A. As used in this section:

"Best management practice" means one or more schedules of activities, prohibition of practices, maintenance procedures, and other management practices, including both structural and nonstructural practices, to prevent or reduce the pollution of surface waters and groundwater systems.

"Stormwater" means precipitation that is discharged across the land surface or through conveyances to one or more waterways and that may include stormwater runoff, snow melt runoff, or surface runoff and drainage.

B. The board of directors of each association shall be responsible for inspecting and maintaining any stormwater best management practice that serves and is operated or owned by the development.
