Be it enacted by the General Assembly of Virginia:

1. §1. That the Safety and Health Codes Board (the Board) of the Department of Labor and Industry (the Department) shall adopt regulations to the Virginia Occupational Safety and Health Program (VOSH), regarding cranes and derricks in construction, to allow an active load stabilization mechanism or passive load stabilization mechanism to be used if necessary to prevent hazardous rotation of a load as determined by the project manager or safety engineer. For the purposes of this act, "active load stabilization mechanism" means any external device attached to the bottom hook of a crane or similar lifting machine that stabilizes any load with computerized control and human input in order to enhance worker safety, and "passive load stabilization mechanism" means any external device attached to the bottom hook of a crane or similar lifting machine that uses the natural environment to manipulate any load with human input.

The Department shall report the final regulations to the Chairmen of the House Committee on General Laws and the Senate Committee on General Laws and Technology by November 1, 2023. If it is determined that the adoption of such regulations violates federal law, the Department shall include a detailed explanation of the reasons why it is not feasible to adopt such regulations in its report.
