AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to allow the Board of Nursing to waive its regulations related to nursing faculty ratios.
Be it enacted by the General Assembly of Virginia:
1. § 1. The Board of Nursing (the Board) shall allow nursing education programs in the Commonwealth to apply for a waiver of the student-to-faculty ratios for direct client care in 18VAC90-27-60 and 18VAC90-27-110 of the Virginia Administrative Code. Such waiver shall permit a nursing education program to increase the ratio of students to faculty engaged in direct client care from 10 students per faculty member up to, but not to exceed, 15 students per faculty member. Upon application for such waiver by a nursing education program, the Board shall determine whether the nursing education program has provided supporting evidence of an appropriate implementation plan, demonstrated that the program can safely waive the required ratio in each practice setting for which the waiver is requested, and demonstrated that the waiver would support program needs while maintaining the safety of patients and the public. The Board shall further determine any necessary compliance measures, including review of the clinical program at intervals determined by the Board. The Board may withdraw the waiver based on findings of such reviews and may extend the waiver as many times as the Board deems warranted.
