A BILL to amend the Code of Virginia by adding in Article 5 of Chapter 20 of Title 15.2 a section numbered 15.2-2031, relating to exchange of items on roadways; ability of localities to prohibit.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Article 5 of Chapter 20 of Title 15.2 a section numbered 15.2-2031 as follows:
§ 15.2-2031. Localities may prohibit exchange of items on roadways.
A. Localities may by ordinance prohibit pedestrians from exchanging, or attempting to exchange, any item with the occupant of a motor vehicle located on a roadway in such locality and prohibit an occupant of a motor vehicle located on a roadway in such locality from exchanging, or attempting to exchange, any item with a pedestrian.
B. The provisions of any such ordinance shall not apply:
1. When the motor vehicle is lawfully parked in a designated parking area;
2. To the exchange of items during an emergency situation where such exchange is necessary for the safety or health of an individual;
3. On private property; or
4. To the exchange of items with law-enforcement officers, emergency personnel, or other government officials performing their official duties.
C. Violation of any such ordinance may be made punishable by a fine of not more than $50.
