Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 33.1-23.4:02 as follows:

§33.1-23.4:02. Allocation of funds for certain contract fees for railroad right-of-way access.

Funds for contract fees paid by the Virginia Railway Express for access to the rights-of-way of CSX Transportation, Norfolk Southern Corporation, and the National Railroad Passenger Corporation shall be allocated from the public transportation portion of federal Surface Transportation Program funds.
